UPDATED: OYETOLA DEFEATS ADELEKE AT THE COURT OF APPEAL
Governor Gboyega Isiaka Oyetola and Senator Ademola Adeleke
The Appeal Court today in Abuja has nullified the victory of Ademola Adeleke at the State of Osun governorship election petition tribunal.
This followed the appeal filed by the Governor of the State of Osun, Gboyega Oyetola, challenging the declaration of Ademola Adeleke as the duly elected governor of Osun State by the state election petition tribunal.
The appellate court also set aside the judgement of the tribunal of March 22, which declared Mr Adeleke winner of the election.
A five-member panel of the appeal court led by Jummai Sankey delivered the judgement with three members of the panel agreeing with the lead judgement.
The three other judges in agreement with the lead judgement read by Jummai Sankey are Abubakar Yahaya, Isaiah Akeju, and Bitrus Sanga.
A panel member, George Mbaba, gave a dissenting judgement.
The Court of Appeal’s majority judgment was primarily anchored on the alleged absence of a member of the tribunal, Justice Peter Obiorah, who read the lead majority verdict of the tribunal, during the February 6, 2018 proceedings of the tribunal.
Justice Sankey held that absence of Justice Obiorah on that date nullified the entire proceedings and the verdict of the tribunal.
